1. Introduction
These terms describe your use of KML KMZ Viewer, published by Chiranjeevi Pandey. For questions or support, contact sublimecoder247@gmail.com.
2. App license and these terms
The license for the App Store version of the app is governed by Apple's Standard Licensed Application End User License Agreement, unless a different license is expressly supplied with the app. These terms supplement that license with product-specific conditions. They do not replace Apple's agreement or reduce mandatory rights you have under applicable law. If a provision conflicts with that license or a nonwaivable legal right, the controlling license or legal requirement prevails.
Use the app only if you can lawfully agree to the applicable terms, or with the involvement of a parent or guardian where required. If you do not agree, discontinue use and uninstall the app after preserving files you need.
These terms do not require you to waive privacy rights or consent to optional processing. A separate privacy choice remains separate from the app license.
3. What the app provides
The app imports local KML and KMZ files, displays supported map features using Apple Maps, and provides a file library, feature details, folders, and search. It is a viewer, and does not currently provide map editing, route guidance, or managed offline basemap downloads.
Not every KML extension, style, or archive is supported. Some features may be skipped, simplified, or displayed differently from the source application's presentation. Large, malformed, or unsupported files may fail to open. The app may display warnings, but a successful import does not establish that the source data is complete or accurate.
Map services, remote images, and external links depend on third parties and network availability. Their content and availability may change independently of the app. Updates may change supported features or device requirements; we do not guarantee continuing availability of any external service.
4. Your files and responsibilities
You retain ownership of your files and their contents. Importing a file does not transfer ownership to us. You are responsible for having permission to access, use, and share its contents, including images, location data, and personal information about others.
The app processes your selected content to provide the viewing and sharing actions you request. It does not grant us a right to publish your files or reuse them for advertising or AI training. If you voluntarily send a file for support, we use it for handling that request as described in the Privacy Policy. Send only content you are entitled to disclose and remove information that is unnecessary for troubleshooting.
Use the app lawfully. Do not use it to infringe intellectual property or privacy rights, conduct unlawful surveillance or harassment, distribute malicious content, or bypass security safeguards. Restrictions on modification or reverse engineering apply only to the extent permitted by the applicable license and law; they do not limit rights granted by open-source licenses or mandatory law.
Keep independent copies of important source files. Library deletion removes the app's copy, and uninstalling may remove local data. Removing a layer from the map does not delete its library file. We do not operate a backup or recovery service for your imported content.
5. Maps, accuracy, and appropriate use
Coordinates, descriptions, boundaries, and attributes come from the imported file, while basemaps come from Apple. Either source may be inaccurate, outdated, incomplete, or unsuitable for your purpose. Verify important information with authoritative sources and current conditions.
The app is intended for general map viewing. Do not rely on it as the sole source for navigation, emergency response, surveying, determining legal property boundaries, or decisions where incorrect location information could cause injury or loss. Use the app safely and avoid interacting with it while driving or operating equipment.
6. Privacy and external services
The Privacy Policy explains local storage, optional location access, automatic remote marker icon requests, optional remote description photos, sharing, backups, and support correspondence. It describes information handling; it does not replace any separate permission or consent required by law or iOS.
Apple Maps, Files providers, websites, image hosts, and sharing destinations are independent services with their own terms and privacy practices. Opening or sharing content through them is subject to those practices. We do not control third-party content or endorse it simply because the app displays a link or image.
Remote marker icons may load automatically, while remote description photos require enabling the relevant control. Opening a file can therefore generate requests to image hosts chosen by the file's author. Reviewing a policy or accepting these terms does not certify those hosts as safe. Use trusted files and take care before enabling remote photos or opening external links.
7. Purchases and availability
The current app does not include in-app purchases or subscriptions. Any App Store download price, transaction, or refund is subject to Apple's applicable purchase terms and consumer law. Future paid features, if introduced, will have their prices and applicable conditions disclosed before purchase.
8. Ending use and support
You can stop using the app at any time. Save or share copies of any imported files you need before deleting them or uninstalling. Stopping use does not require an account closure, because the current app has no user accounts. We cannot remotely retrieve your local library for you.
We may stop maintaining or distributing the app. Any applicable obligations concerning purchased digital content, remedies, or required updates remain governed by the app license and consumer law. Contact us to report a defect or request help; these terms do not guarantee a particular support response time or a fix for every file.
9. Warranties and liability
To the extent permitted by applicable law, the app and its displayed content are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, compatibility with every file, or the accuracy or availability of maps and third-party content. Applicable warranty provisions in the app's license also apply.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from your use of the app, including losses caused by reliance on inaccurate source data or unavailable third-party services. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or death or personal injury caused by negligence where applicable, or your mandatory consumer remedies.
Consumers retain any mandatory rights concerning conformity of digital content, remedies, refunds, and unfair contract terms that apply in their jurisdiction. These rights prevail over inconsistent warranty or liability wording above. No provision requires you to give up a right to contact a regulator or bring a legally permitted claim.
10. Changes and contact
We may update these terms for changes to the app or legal requirements, identifying the revision date above. Material changes will be communicated through an appropriate channel, and acceptance will be requested where required by law. Changes do not retrospectively remove accrued rights. If you disagree with revised terms, you can stop using the app while keeping copies of your original files.
If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms do not require arbitration, select a court, or override the governing-law provisions of Apple's license or mandatory local law.
