Terms of Service

Please read these Terms of Service ("Terms") carefully before using ProperImage ("the App") operated by Chiranjeevi Pandey ("we," "our," or "us").

By downloading, installing, or using ProperImage, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using ProperImage, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and agree to comply with these Terms.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use ProperImage on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

This license does not allow you to:

  • Copy, modify, or distribute the App
  • Reverse-engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Use the App for any unlawful purpose
  • Remove or alter any proprietary notices in the App

3. Your Content

ProperImage processes images you select entirely on your device. You retain all rights to your images and the files you create. We claim no ownership over, and have no access to, your content.

You are solely responsible for the images you process and for ensuring you have the rights to use them. Do not use ProperImage to create or distribute content that is illegal or that infringes the rights of others.

4. Privacy and Notifications

Our handling of data is described in our Privacy Policy. In summary, your images are processed on your device, and we collect only anonymous usage analytics, crash diagnostics, and purchase data to operate and improve the App.

If you grant permission, the App may send push notifications with updates and offers. You can disable notifications at any time in iOS Settings.

5. Intellectual Property

ProperImage, including its design, code, features, and branding, is owned by Chiranjeevi Pandey and protected by copyright, trademark, and other intellectual property laws. All trademarks and trade names used in the App are the property of their respective owners.

6. Subscriptions and Purchases

ProperImage offers an optional Pro upgrade through in-app purchases, including auto-renewing subscriptions and a one-time lifetime purchase.

Pricing

  • All prices are displayed in your local currency through the App Store.
  • Prices may change with notice. Existing subscribers will be notified before renewal at a new price.

Subscriptions

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel subscriptions in your Apple ID account settings.

Lifetime Purchase

  • The lifetime unlock is a one-time, non-consumable purchase that grants access to current Pro features. It does not auto-renew.

Free Trials

  • If a free trial is offered, it automatically converts to a paid subscription unless cancelled before the trial ends.
  • Trial eligibility is determined by Apple and limited to one trial per Apple ID.

Refunds

7. Termination

We may suspend or terminate your access to ProperImage at any time for violation of these Terms. Upon termination, your license to use the App is revoked. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive. You may terminate your use at any time by deleting the App.

8. Disclaimer of Warranties

PROPERIMAGE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure, that defects will be corrected, or that processing will never result in data loss. Always keep backups of important images.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIRANJEEVI PANDEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF PROPERIMAGE.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

10. Governing Law

These Terms are governed by the laws of Nepal, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Nepal.

11. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last Updated" date above. Continued use of ProperImage after changes are posted constitutes acceptance of the updated Terms.
